TERMS OF SERVICE AGREEMENT
PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY SIGNING BELOW, YOU HEREBY AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE PHOTOGRAPHED PARTY TO READ THE TERMS AND CONDITIONS BEFORE SERVICES ARE RENDERED.
SECTION I - DEPOSITS
i. Every booking requires a deposit equal to 50% of the total booking cost in order to be locked in and confirmed.
ii. Deposits are non-refundable, but are applied towards the total booking cost.
SECTION II - ACCOUNTABILITY CLAUSE
i. If a booking is postponed or cancelled within 12 hours of the pre-determined booking time, a cancellation fee of $50 USD will be applied. If the booking takes place within one week of the
cancellation, the cancellation fee will be used to satisfy a portion of the total cost of the booking. If the booking takes place beyond one week of the agreed booking date, a new booking, and therefore, a new booking fee, will be required.
SECTION III - PHOTO DELIVERY
i. Prior to photo delivery, the Photographer will narrow down the amount of photos taken, to include three times the amount of photos included in the package purchased by the Client.
ii. RAW photos will not be released.
SECTION IV - MANIPULATION
i. Final edits are not to be altered in any way unless approved by the Photographer. This includes coloring, white balance, orientation, and other manipulations that may deter from the initial edit. A manipulation fee of $25 USD per photo altered will be added if this clause is not followed.
SECTION V - RIGHTS & USAGE
i. Intended usage of all photos taken and/or delivered is to be discussed between the Photographer and the client prior to services rendered. Any usage of copyrighted photos beyond the initial agreement will incur additional charges.
ii. The Image Rights Fee is a flat-rate fee calculated at the Photographer’s discretion based on the quantity of photos that may be taken and possibly used by the Client as well as intended usage of photos.
SECTION VI - COVID-19 CLAUSE
i. The Photographer relinquishes any and all liability for any illnesses the Client or involved parties may contract during the period of time for which the Photoshoot takes place.
SECTION VII - COMPOSITES
i. Composite Images are regarded as paintings and therefore, are not subject to alterations after being completed.
